The following names are pending trademark registration with IP Australia, all applied for concurrently:

  • XOFFICERS™

  • XCLARITAS™ (Understand)

  • XIMPETUS™ (Adapt and Respond)

  • XSUPERARE™ (Overcome)

The ™ symbol indicates a pending trademark application. These names may not be used by any third party without the prior written consent of XOFFICERS Pty Ltd.

On confirmation of registration by IP Australia, the ™ symbol will be updated to ® for all four names across all XOFFICERS materials.

XOFFICERS™ is a pending trademark application. On confirmation of registration it will carry the ® symbol. “XOFFICERS” is the trading name of XOFFICERS Pty Ltd (ABN 75 698 697 317).

The tagline “Understand · Adapt & Respond · Overcome” and the strapline “Execution Leadership, Multiplied.” are proprietary to XOFFICERS Pty Ltd.

2.3  Diagnostic instruments and methodologies

The XCLARITAS™, XIMPETUS™, and XSUPERARE™ diagnostic instruments, their statement sets, scoring methodologies, and output architectures are proprietary to XOFFICERS Pty Ltd. They are licensed for use under a royalty licence agreement. Any reproduction, adaptation, or commercial use of these instruments without written licence is prohibited.

3.  Website Use

You may use xofficers.com for lawful purposes only. You may not:

  • Use the website in any way that breaches any applicable law or regulation.

  • Use the website to transmit unsolicited commercial communications.

  • Attempt to gain unauthorised access to any part of the website or its underlying systems.

  • Reproduce or distribute any content from the website without prior written permission.

6.  Engagement Services

XOFFICERS Pty Ltd delivers facilitation, diagnostic, and execution leadership services under separate written engagement agreements. The terms of those agreements govern the service relationship. In any conflict between these Terms of Use and a written engagement agreement, the engagement agreement takes precedence.

XOFFICERS principals work alongside client teams as experienced operators. The accountability for organisational outcomes stays with the client organisation throughout every engagement. XOFFICERS Pty Ltd does not accept accountability for client decisions made during or following an engagement.

7.  Privacy

Our collection and use of personal information is governed by our Privacy Policy, available at xofficers.com/privacy-policy.

8.  Governing Law

These Terms of Use are governed by the laws of Queensland, Australia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of Queensland.

9.  Changes to These Terms

We may update these Terms of Use from time to time. The current version is always available at xofficers.com/legal. The “Last updated” date at the top of this page reflects when the terms were last revised. Continued use of the website after a revision constitutes acceptance of the updated terms.
